Terms & Conditions

1. Definitions
In these Terms and Conditions:
- "We / Us / Our" refers to Lindung Sejahtera, a legal practice registered and operating in Malaysia.
- "You / User" refers to any individual who contacts us, engages our services, or uses our website.
- "Services" refers to the legal services described on our website, including First Pension Consultation, Managing Fund Communication, and Formal Proceedings & Representation.
- "Agreement" refers to the terms set out here together with any written engagement letter issued by us.
2. Acceptance of Terms
By engaging our services or submitting an enquiry through our website, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. Use of our website without engaging services does not itself constitute an agreement between us.
3. Description of Services
We provide legal support services in relation to pension matters in Malaysia. Our three services are:
- First Pension Consultation (RM 239) — a review of your documents and position, with options explained.
- Managing Fund Communication (RM 286) — drafting and managing correspondence with pension funds and authorities on your behalf.
- Formal Proceedings & Representation (RM 325) — preparation and presentation of formal proceedings, including attendance where required.
Services are available to individuals in Malaysia and may be delivered in person at our Kuala Lumpur office or remotely. Service availability is subject to our capacity and professional judgement as to whether we are able to assist in a particular matter.
4. Engagement
A formal engagement between you and Lindung Sejahtera commences upon your acceptance of our written engagement letter. No service obligation arises from an initial enquiry or consultation alone. We reserve the right to decline to act in any matter at our professional discretion, including where a conflict of interest exists or where we determine that the matter falls outside our area of practice.
5. Payment Terms
Our fees are stated in Malaysian Ringgit (RM) and are payable as follows:
- Payment is due prior to commencement of work unless otherwise agreed in writing.
- Accepted payment methods include bank transfer and other methods agreed at the time of engagement.
- Fees stated on our website represent the fixed fee for the scope described. Work falling outside that scope will be discussed and agreed separately before being undertaken.
6. Cancellation and Refund Policy
If you wish to cancel an engagement before work has commenced, please notify us in writing. Where work has not begun, we will refund any fee paid in full. Where work has commenced, refunds will be assessed on a pro-rata basis reflecting the work completed. Consultations that have been attended are non-refundable.
7. User Responsibilities
In engaging our services, you agree to:
- Provide accurate and complete information relevant to your matter
- Notify us promptly of any changes to information previously provided
- Respond to our requests for instructions or documents within a reasonable time
- Not use our services for any purpose that is unlawful or contrary to professional legal standards
8. Intellectual Property
All content on our website — including text, design, and materials — is the property of Lindung Sejahtera or its licensors. You may not reproduce, distribute, or use such content without our prior written consent. Legal documents and advice prepared for your matter remain our intellectual property until fees are paid in full.
9. Disclaimer
Our services constitute legal support and advice, not a commitment to any particular outcome. The outcome of pension matters depends on many factors outside our control, including the decisions of pension fund administrators and regulatory bodies. Nothing in our engagement or on our website should be understood as an assurance of a specific result.
10. Limitation of Liability
To the extent permitted by Malaysian law, our liability to you in connection with the services provided is limited to the fees paid for the relevant service. We are not liable for indirect or consequential loss arising from the use of our services or from decisions made by third parties in connection with your pension matter.
11. Confidentiality
All information shared with us in connection with your matter is treated as confidential in accordance with our professional obligations. We do not disclose client information to third parties except as necessary to carry out the services you have engaged, or as required by law.
12. Termination
Either party may terminate an engagement by giving written notice. We may cease acting for you if you fail to provide instructions, fail to pay fees when due, or if continuing to act would place us in breach of our professional obligations. Upon termination, fees for work completed remain payable.
13. Governing Law and Disputes
These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising in connection with them shall be subject to the jurisdiction of the courts of Malaysia. We encourage parties to seek to resolve any disagreement through direct communication before commencing formal proceedings.
14. General Provisions
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full effect. Our failure to enforce any right does not constitute a waiver of that right. These Terms constitute the entire agreement between us regarding the subject matter herein, and supersede any prior discussions or representations not recorded in writing.
15. Changes to These Terms
We may update these Terms from time to time. Updated terms will be posted on this page with a revised date. Continued use of our services or website after such changes constitutes acceptance of the updated terms.
